AGREEMENT TO TERMS & CONDITIONS
These Terms and Conditions are a binding Agreement between you and ComicPull.com, ComicPull.ca and ComicPull in general. Please read them carefully.
ComicPull, ComicPull.com, ComicPull.ca, The 4th Wall Inc., and Blind Ferret Entertainment Inc., producer of and its related content and service sites, believes that electronic privacy is crucial for the ongoing success of the Internet as a service, commercial, and entertainment medium. We know you're concerned about protecting your privacy online. Rest assured that we treat your personal information (especially payment information) with the highest standards of safety, security, and confidentiality.
We don't collect personal information without your knowledge. We don't sell, rent, or give your personal information to unrelated third parties without your prior permission. This policy explains what information we collect about you and how we use that information. We also outline the choices you have.
ComicPull.com (and ComicPull.ca):
ComicPull and its partners pledge a safe and worry-free shopping experience. We use the industry standard for Internet security, Secure Sockets Layer (SSL 128-bit) encryption to protect your personal data and ensure that it is transmitted securely.
Each time a visitor comes to ComicPull.com, information is collected to improve the overall quality of our website. Comic Pull collects the visitor's domain name/IP Address (e.g., whether the user is logged on from netscape.com or yale.edu or 255.255.255.0), referral data (e.g., we record the address of the last URL a user visited prior to clicking through to an Blind Ferret Entertainment site), and browser/platform type (e.g., a Netscape browser on a Macintosh platform).
Comic Pull also counts, tracks, and aggregates the visitor's activity into our analysis of general traffic flow (e.g., tracking where traffic comes from and how traffic flows within the sites). Comic Pull may merge this information into group data, which may then be shared on an aggregated basis with research firms, and business partners. Comic Pull will not disclose your individual identity or personal data. When we present aggregated information to research firms, and business partners, no one will be able to identify you or contact you.
Any/all e-mail addresses sent to us as the result of correspondence with the consumer will not be used or collected for the purposes of reselling to a third party and will not be added to a bulk e-mailing list.
Comic Pull provides users the opportunity to opt-in and opt-out of receiving e-mail communications from us. This is made available during sign-up for our e-mail lists and in e-mail messages delivered from Comic Pull. For any list managed by Comic Pull, users can use the link in the footer of most e-mail messages to unsubscribe.
You agree to provide us with an active e-mail address; you consent to receiving business-related e-mail communications from us using that e-mail address, and agree that notices relating to your account will be effective if sent to the e-mail address you provided.
We may provide links to material on websites other than ours. We make no representations concerning the accuracy of those sites or the privacy or other policies of those site operators.
Sharing and Usage of Information:
Comic Pull never shares, sells, or rents any personal information without your permission, unless ordered by a court of law. Information submitted to us is only available to employees managing this information for purposes of contacting you or sending you emails based on your request for information.
Product Availability Changes:
Sometimes, books and comics become unavailable at the distributor level. This can be for many reasons, including stock shortages, series cancellations or the issue in question simply being to old to stock. We try and maintain the most current and up to date list of items that are available, but sometimes things beyond our control happen. If you have pre-paid for a book that becomes unavailable, your money will be happily refunded. If it is a book that you've subscribed to, don't worry because you aren't charged until the book ships from our facility. If it becomes unavailable and never gets here, you'll never be charged. ComicPull is also not responsible for items delayed, changed or cancelled by publishers or individual creators.
Adding/Removing series and Items from an account:
ComicPull is not responsible for the addition or removal of items or series from individual accounts. This is solely the responsibility of the user.
If you receive a product from us that is defective, you may notify us of the condition in which it was received and exchange it for another copy of the same title (provided copies are available), exchange it for a different title (of the same value), or keep a credit for a future purchase. Due to the nature of the business, we can only accept returns for damaged goods. If you receive any damaged goods, please contact us (email@example.com) with 7 days of receipt in order to request a refund, exchange or credit.
Please keep in mind that comics are somewhat fragile and it can happen that even new comics may have minor blemishes. They may have been shipped or handled by sales personnel, even though they are still new. It is typical for a new comic book to have a few minor blemishes, including small spine cracks and slight bindery or printing defects (such as, for example, a cover that has been cut a little crooked, or a page with an irregular edge). These minor faults are expected, and we will not accept returns on such comics. ComicPull will do our best to sort out any issues not fit to send, and acquire replacements for them, ensuring you the best possible copy.
"Defective" merchandise is defined as a comic or graphic novel that is undreadable (missing or blank pages, smeared ink, etc) or containing any major defects that, though not impairing readability, would substantially interfere with the average reader’s enjoyment. These would include permanent creases, dog-eared corners, or printing imperfections that make reading more difficult.
Return of Merchandise:
Defective merchandise (as defined above) that was delivered damaged may be returned within one week after it arrives, complete with all packaging and any accompanying written material. If postage is paid by you, your return postage cost will be refunded. If you use a postage-paid return sticker, that means that we pay the postage.
ComicPull will do it's best to ensure that your orders are delivered in a timely manner. ComicPull is not responsible for shipping delays caused by USPS, Canada Post or any other outside contributing factor.
Content Warning and Disclaimer:
ComicPull offers comic books and graphic novels written and published by others, and is in NO WAY responsible for their content. You assume full reponsibility for ComicPull purchases and their content and any complaints or issues relating to content should be directed at the publishers of said item and not ComicPull.
In the event of an issue that reaches litigation, you and ComicPull agree that all issues shall be resolved by binding arbitration in Quebec, Canada, and that if any issue goes to court, only the provincial or federal courts of Quebec shall have jurisdiction over any dispute relating to ComicPull’s service or these Terms and Conditions, that Quebec law will apply, and that you irrevocably consent to personal jurisdiction and venue in these Quebec courts.
If you wish to cancel your account, you must sent a notice to Info@comicpull.com. One of our customer service agents will respond and make arrangements for any outstanding balances or items on your account, at which time it will be closed. Removing series from your pull list does not take into account items that have already been ordered. These items will be shipped to you in accordance to your preferences unless we hear from you otherwise.
For In-Store Pickup Customers: If you wish to cancel your account, you must follow the above steps. If your items are not picked up within 3 months of release, your credit card may be billed the full amount and the comics shipped to your shipping address. At that time your items will be released and your account will be declared "abandoned" and closed. If necessary, steps may be taken to recover lost revenue.
For Shipping Customers: If we are unable to successfully charge your credit card for your purchases, you will be notified immediately. A follow-up attempt will be made within 7 business days. If you account remains without a vaild or chargeable credit card for 3 months, your items will be released and your account will be declared "abandoned" and closed. If necessary, steps may be taken to recover lost revenue.
Please keep in mind, in all instances, if you order items through comicpull.com (or comicpull.ca) you are responsible for the payment for said items. This means that if buy the same item through another service, store or elsewhere and do not contact us in time to cancel your order, you will still be responsible for payment of the item ordered through ComicPull.
